President Obama signs the National Defense Authorization Act after months of debate.

The National Defense Authorization Act greatly expands the power and scope of the federal government to fight the War on Terror, including codifying into law the indefinite detention of terrorism suspects without trial. Under the new law the US military has the power to carry out domestic anti-terrorism operations on US soil.

"The fact that I support this bill as a whole does not mean I agree with everything in it," the president said in a statement. "I have signed this bill despite having serious reservations with certain provisions that regulate the detention, interrogation and prosecution of suspected terrorists."

Worse, the NDAA authorizes the military to detain even US citizens under the broad new anti-terrorism provisions provided in the bill, once again without trial.

There is some controversy on this point, in part because the law as written is entirely too vague. But whether or not the law will be used to indefinitely detain US citizens domestically, it is written to allow the detention of US citizens abroad as well as foreigners without trial.

"Obama's signing statement seems to suggest he already believe he has the authority to indefinitely detain Americans—he just never intends to use it," Adam Serwer writes at Mother Jones. "Left unsaid, perhaps deliberately, is the distinction that has dominated the debate over the defense bill: the difference between detaining an American captured domestically or abroad. This is why ACLU Director Anthony Romero released a statement shortly after Obama's arguing the authority in the defense bill could "be used by this and future presidents to militarily detain people captured far from any battlefield."

The NDAA Makes the Status Quo Worse

Glenn Greenwald makes a compelling case that the law gives the government truly frightening powers. He notes that section 1022 exempts US citizens from the requirement of military detention but still leaves the option open to the state.

"The only provision from which U.S. citizens are exempted here is the"requirement" of military detention," Greenwald writes. "For foreign nationals accused of being members of Al Qaeda, military detention is mandatory; for U.S. citizens, it is optional. This section does not exempt U.S citizens from the presidential power of military detention: only from the requirement of military detention."

"The most important point on this issue is the same as underscored in the prior two points: the "compromise" reached by Congress includes language preserving the status quo," he continues. "That's because the Obama administration already argues that the original 2001 AUMF authorizes them to act against U.S. citizens (obviously, if they believe they have thepower to target U.S. citizens for assassination, then they believe they have the power to detain U.S. citizens as enemy combatants). The proof that this bill does not expressly exempt U.S. citizens or those captured on U.S. soil is that amendments offered by Sen. Feinstein providing expressly for those exemptions were rejected. The "compromise" was to preserve the status quo by including the provision that the bill is not intended to alter it with regard to American citizens, but that's because proponents of broad detention powers are confident that the status quo already permits such detention."

In part the National Defense Authorization Act helps to preserve the status quo established a decade ago with the original provisions in the PATRIOT Act giving the government broad new powers in the so-called War on Terror. In part the bill expands those powers, codifying the use of indefinite detention of foreign nationals and possibly US citizens arrested abroad and at home. In part the bill expands the use of the US military on domestic soil, at once complicating anti-terrorism strategies at home and raising serious questions about the role of the military in law enforcement.

All these things should make Americans – and not
just Americans – very nervous about the preservation of their civil liberties. That precarious balance between security and liberty is looking ever more tilted toward the former and away from the latter.

The History of Anti-Terrorism is Bad News for Civil Liberties

Just as troubling, these laws suggest that the legal apparatus available to us is insufficient to the task. While due process may work for any other criminal act, terrorism is unique and requires new and expanded powers that ignore the Constitution. These powers are necessary until "hostilities end" – as though terror itself can ever be extinguished.

In the 1970′s the British government began passing a series of anti-terrorism laws that did many of the same things the US government has done since 9/11. At the time, detention without charge was expanded to seven days. Various other powers of arrest and detention were written into law, and these provisions were expanded gradually through the 1980′s as the British government continued to wage its war against the Irish Republican Army.

Far from wiping these laws from the books when the IRA disarmed, many of these laws were simply reinforced by the 2001 Anti-Terrorism, Crime and Security Act and the 2005 Prevention of Terrorism Act.

The problem with fighting a war on terror is that it's in many ways a war on ideas. The IRA may have disbanded, but that didn't stop terror from taking a new shape in the form of Al-Qaeda. Britain's struggle against Irish dissidents may have been a good excuse for earlier anti-terror legislation, but Islamic radicalism is just as potent a threat.

You Can't Wage a War on an Idea

In the United States the Cold War had barely ended before the threat of terrorism replaced it and, in some ways, became an even more urgent reason to expand government power at the expense of privacy and civil liberties. Unlike the Cold War, Americans have actually died in the War on Terror. Also unlike the Cold War, the enemy we face is not embodied in another country or people, but rather in a form.

Terrorism is a tactic, not a state. It is used to create overreaction in its targets. The initial reaction by the US government to the 9/11 attacks was understandable but wrong-headed. Over a decade after that national tragedy, the government is still overreacting. Each time we allow our fear to undermine our freedom we concede to the very terrorists we hope to defeat.

"The legislation could also give future presidents the authority to throw American citizens into prison for life without charges or a trial," said Sen. Bernie Sanders in a statement. "This bill also contains misguided provisions that in the name of fighting terrorism essentially authorize the indefinite imprisonment of American citizens without charges. While we must aggressively pursue international terrorists and all of those who would do us harm, we must do it in a way that protects the Constitution and the civil liberties which make us proud to be Americans."

Time for a Civil Liberties Caucus

Support for the National Defense Authorization Act is decidedly bipartisan. Opponents like Senator Sanders (an independent who describes himself as a socialist) and Rand Paul (a Republican and a libertarian) also come from both sides of the aisle.

The same people tend to be opponents of other civil-liberty-quashing bills like the Stop Online Piracy Act and the Protect IP Act, two bills being debated in congress which would give the government and the industry sponsors of the bills broad new powers over the internet and freedom of speech online.

To me, this underscores the need to look beyond politics as usual.

Technology is changing the way institutions, governments, and individuals interact. The symmetry of power is shifting and governments and non-state actors alike are scrambling to keep up. Sometimes this creates real security threats.

Hacking outfits like Anonymous present a real challenge to governments and corporations. At times these groups may act honorably, attempting to expose corruption. At times they may act without such noble intentions. Either way there is no denying that security is an issue going forward and that the overreaction of governments to a myriad security risks poses its own set of problems and challenges.

I've written in the past that people concerned with civil liberties should begin to walk away from the old left-right dichotomy entirely and focus on electing civil libertarians to congress whether these are members of the left like Russ Feingold or of the right like Rand Paul. Of course, both Paul and Feingold will fall short of the ideal civil libertarian when it comes down to it, but both are a far cry better than 90% of their colleagues.

We have few options available to us at this point. The NDAA may be challenged in the courts, and this will almost certainly happen if the president (or a future president) actually makes use of the powers related to US citizens. Even then, however, the courts could come down on either side. The Supreme Court is not exactly filled to the brim with civil libertarians.

Until that time, however, we can try to abandon politics-as-usual and focus on electing politicians who care more about curtailing government excess than expanding government power endlessly in our never-ending War on Terror. And we can use technology, social media, and other tools at our disposal to act outside of politics altogether to work to create alternate institutions and communities.

The Iowa caucuses tell us that the campaign season is now upon us. While we focus on the Republican candidates, there will likely only be one Democratic candidate for president. If you still need a reason to defeat Obama in 2012 consider his administration's intense effort to deprive America of the energy it needs to function and compete in the world.

If a foreign nation had launched an attack on America to destroy its coal-fired plants, to shut down its coal mines, and to thwart its ability to drill for oil and natural gas, we would be at war with it.

Obama is at war with America. Between the waste of billions squandered on "Green" energy and the attacks on all aspects of the energy industries in America, the one reason to defeat Obama is your ability to turn on the lights, turn on your computer, and ensure that American business and industry has the energy necessary to exist and compete.

Just try to imagine what your life would be without adequate, reliable electricity.

As a Wall Street Journal editorial recently warned, "Last week the Federal Energy Regulatory Commission convened a conference on the wave of Environmental Protection Agency rules that are designed to force dozens of coal-fired power plants to shut down…despite warnings from expert after expert, including some of its own, the FERC Commissioners refuse to do anything about this looming threat to electric reliability."

The North American Electric Reliability Corporation (NERC) warned that "Environmental regulations are shown to be the number one risk to reliability over the next one to five years."

The editorial noted that "For the first time in U.S. history, net coal capacity is in decline. On top of 38 gigawatts of generation that is already being run below normal levels or slated for early retirement, NERC predicts another 36 to 59 gigawatts will come offline by 2018, depending on the 'scope and timing' of EPA demands. That could mean nearly a quarter of all coal-fired capacity."

It is coal-fired plants that currently provide fifty percent of all the electricity generated in America! The EPA is feverishly trying to force a quarter of that capacity offline. Why? Because the EPA claims that these plants are "polluting" the air. The air in America has never been cleaner. The EPA demand for cleaner air is a bludgeon being used to deprive America of its ability to function.

America has more than 497 billion short tons of recoverable coal (not counting Alaska) or nearly three times as much as Russia, which has the world's second largest reserve. According to the Institute for Energy Research, "America's recoverable coal resources are bigger than the five largest non-North American countries' reserves combined," i.e., Russia, China, Australia, India and the Ukraine.

The Obama administration delayed the proposed Canadian Keystone XL pipeline that would provide more oil for America's needs. It imposed an illegal moratorium on oil drilling in the Gulf of Mexico. While China drills for oil off the coast of Cuba, access to offshore oil is restricted on both the East and West coasts of America and, of course, in the Arctic National Wildlife Refuge. According to the Department of Interior's 1987 resource evaluation of ANWR's Coastal Plain, there is a 95% chance that a 'super field' with 500 million barrels would be discovered.

Meanwhile, when combined with resources in Canada and Mexico, the total recoverable oil in North America exceeds 1.7 trillion barrels! That is more than the entire world has used in the past 150 years and sufficient to fuel the present needs in the United States for the next 250 years!

The same holds true for natural gas, often accessed by "fracking" a safe process that has been in use for sixty years. The total amount of recoverable natural gas in North America is approximately 4.2 quadrillion (4,244 trillion) cubic feet. That's enough to last for the next 175 years at current rates of consumption.

In Durban, South Africa the enemies of the United States and all industrialized Western nations recently gathered at yet another United Nations conference on climate change. Its major objective was to deter energy use by Western industrialized nations or, more accurately, to require that the UN receives billions in return for allowing it.

The global warming claim on which the EPA is basing its horrendous rules and regulations is a complete and total lie. There is no human-caused global warming.

The Committee for a Constructive Tomorrow (CFACT) attended the conference to monitor its mischief and reports that "Obama and his fellow climate travelers are trying to do an end run around the Senate and stick America with the bill. They are creating side agreements that give them much of what they want from a treaty. These side agreements will not come home for a vote in the Senate or other national legislatures. Previous U.S. Senates have refused to ratify UN climate treaties such as the Kyoto Protocols that called for limits on greenhouse gases.

Global warming claims, the basis for EPA rule-making regarding emissions, have all been refuted and debunked.

Antarctic sea ice is at a near-record extent and is expanding; so too for Arctic ice. The polar bear population is thriving. Sea levels are actually dropping. Global temperatures have been holding steady for a decade and the Earth has been in a cooling cycle since 1998. The frequency of U.S. hurricanes has declined along with the frequency of tornadoes. There is no evidence the Earth is experiencing unusual weather. This list of climate lies is a very long one.

It is all connected, from the halls of the United Nations to the EPA and other U.S. departments working ceaselessly to deprive America of the energy it needs for its very survival.

Obama and his administration must be decisively defeated in November 2012 if the republic is ever to be empowered to pull back from the brink of its destruction.

U.S. Should Invest in Truly Unconventional Forms of Warfare

Cyber-attacks are now recognized as the newest form of nontraditional
warfare that U.S. enemies can employ effectively.

But other varieties of non-military warfare are being waged against the
United States, and have been given less attention. China, for instance, owns
nearly a trillion dollars in U.S. treasuries. It is the largest foreign
owner of U.S. debt. China could use this liability as a weapon. If China
decided to sell these bonds and invest elsewhere, it could have potentially
devastating effects for the U.S. economy.

This is just one example of how non-military warfare can inflict as much
harm upon an enemy as conventional combat. In the 21st century, this kind of
warfare will become increasingly common, and indeed it may one day render
conventional conflicts obsolete. The United States must therefore expand its
own non-military offensive capabilities.

There are three reasons why the nation must develop its own non-military
warfare capabilities if it is to maintain its advantage over adversaries.

First, the scope of warfare is expanding beyond conventional conflicts, and
a failure to adapt will leave the United States incapable of responding.
Costly improvements in capabilities such as the F-22 Raptor serve little
purpose. They are unnecessary to deter attacks because the United States
already possesses an indomitable conventional military advantage and an
enormous nuclear stockpile. They are also unlikely to be used offensively,
as a conventional attack on a powerful adversary risks igniting a
full-fledged war. In contrast, non-military strategies can be used
incrementally and surreptitiously, thus lessening the likeliness of
escalation into a conventional conflict.

Second, U.S. defense spending is unsustainable. It currently exceeds the
rest of the world's defense budget combined. As a result, severe budget cuts
in the near future are inevitable. History illuminates the dangers of rapid
reductions in military spending. After World War II, the Truman
administration drastically reduced spending on conventional military forces,
confident that nuclear weapons would be sufficient to deter adversaries from
attacking. This strategy produced a military incapable of waging the
low-intensity proxy conflicts that were the hallmark of the Cold War, a
deficiency that would not be remedied until the Kennedy administration
recognized the problem more than a decade later and placed an emphasis on
special operations capabilities. The addition of new non-military warfare
options would allow the United States to sustain its military readiness for
a fraction of the cost of maintaining the present conventional force.

Lastly, the addition of non-military capabilities to the existing military
arsenal will allow for increased flexibility. The first half of the 20th
century saw three major wars centered on conventional warfare. This strategy
was not suited to Vietnam and later Iraq and Afghanistan. Future conflicts
will focus less on conventional and unconventional military strategies than
they will on non-military strategies.

The ability of the United States to develop these new methods of waging war
is circumscribed only by its own morality. For example, it should refrain
from engaging in acts of state-sponsored terrorism, such as the North Korean
bombing of Korean Air Flight 858 or the Libyan bombing of Pan Am Flight 103,
because they are anathema to our values and way of life. Narco-warfare - the
infusion of affordable, addictive, and destructive drugs into the society of
an enemy state - is also contradictory to our ideals. The most prominent
example of narco-warfare is when the British Empire forced China to import
its opium, which had devastating effects on the Chinese population. In
addition to being morally reprehensible, the use of these strategies is sure
to draw widespread condemnation from the international community.

But the moral lines regarding other forms of non-military warfare are not so
clear. Cyberwarfare cannot be waged effectively if it does not target
civilian infrastructure along with purely government and military targets.
This is because government and military portals make up but a small
percentage of the virtual battlefield, and thus to limit offensive
operations to the public sector may diminish their effectiveness. Government
and military portals are often "hard targets" in that they are protected by
additional security measures. The most effective cyberwarfare strategy is
therefore indiscriminate. Businesses, banks, utilities, and schools would be
targeted along with the more traditional government and military targets.

Similarly, purely economic warfare is necessarily waged upon the entirety of
an enemy population. Old strategies such as blockades and embargos restrict
the flow of supplies to an enemy population, eroding their quality of life
and willingness to wage war. Kinetic attacks on factories and infrastructure
also sought to reduce the economic output of enemies. Modern economic
warfare strategies are more sophisticated. They rely on economists and other
academics to identify areas of an adversary's economy that are vulnerable to
attack. Once identified, these experts can then undermine financial markets,
manipulate currency exchange rates and target information systems where
critical data is stored.

While many consider the targeting of civilians to be morally unacceptable,
consider that while traditional kinetic military operations target enemy
forces there is frequently considerable collateral damage to civilian
populations. A stray bomb, for example, could kill hundreds of innocent
civilians. By contrast, there is little risk that the use of a non-military
attack targeting civilians directly would result in physical harm. Rather,
it might be said that non-military strategies damage a nation's quality of
life, not life itself. Inasmuch as non-military strategies do not risk
physical harm to civilians, it is arguable that it is more morally
acceptable than traditional military operations.

Ethical issues aside, the reputational and legal implications of engaging in
non-military warfare must also be considered. Warfare of any kind is likely
to draw the ire of the international community, but non-military warfare is
especially susceptible to criticism because it targets civilians.

Non-military warfare also raises issues under international law, which does
not yet clearly define the legal parameters under which non-military wars
can be fought. It is ironic that the battle to shape how international law
treats non-military warfare is itself a form of non-military warfare, as
states raise armies of lawyers and diplomats to shape the currently
undefined international legal framework to their advantage.

Developing non-military capabilities will not be easy for a number of
reasons. First, they will be controversial both at home and abroad as people
question their efficacy, morality and legality. Politicians, military
officials, and bureaucrats alike may therefore be reluctant to endorse
non-military strategies. Second, the effort will require the recruitment of
highly educated civilians, many of whom may be reluctant to participate in
the messy business of war. Third, because non-military warfare is in its
infancy, the development of these new capabilities will necessarily involve
considerable trial, error, time and resources to perfect.

Spending enormous resources to increase the already insurmountable
conventional military advantage cannot compensate for a disadvantage in
non-military warfare capabilities. The face of warfare is changing rapidly,
and the United States must adapt or risk falling behind in the new arms race
of the 21st century.

Americans buy record numbers of guns for Christmas

I own no firearms (at least the registered variety) those things are dangerous. I stopped that nonsense years ago. Every weapon that could ever be traced back to me by old paper records has been sold, traded or given away. I own zero firearms, if you do not believe me then check the records, let the guvment find out where they went. Did I mention that I recently picked up a sweet little firearm like object capable of sending projectiles at high velocity? You have to love Christmas.

Now I am not advocating any of you to break any laws. I will simply remind you all that the biggest threat to your firearms might not be a sixteen year old thief crawling in your back window. If that is really what you are afraid of then by all means register one firearm just to be on the safe side should you feel the need to shoot a crack addicted teenager crawling through your window. Some of us have additional concerns past the punk kid.

According to the FBI, over 1.5 million background checks on customers were requested by gun dealers to the National Instant Criminal Background Check System in December. Nearly 500,000 of those were in the six days before Christmas.
-God bless all law abiding Americans.

It was the highest number ever in a single month, surpassing the previous record set in November.

On Dec 23 alone there were 102,222 background checks, making it the second busiest single day for buying guns in history.
-I feel liberals sweating

The actual number of guns bought may have been even higher if individual customers took home more than one each.
-Not likely, guns are expensive. Most bought only one.

Explanations for America's surge in gun buying include that it is a response to the stalled economy with people fearing crime waves. Another theory is that buyers are rushing to gun shops because they believe tighter firearms laws will be introduced in the future.
-That would be my biggest concern if I owned any.

The National Rifle Association said people were concerned about self defence because police officer numbers were declining.

A warning from a former Muslim

  I was born and raised as Muslim. My whole family is still Muslim. I know every genetic code of Muslim. I know Islamic brain. I live and breath with them. I am an insider. I left Islam when I understood that Islam is a sick and evil religion. The following are the Islamic message to the West.

To the infidels of the West:

The Constitution for the new Islamic Republics of EuroArabia and AmerIslamia is under construction.

We will fight the infidel to death.

- Meanwhile American laws will protect us.
- Democrats and Leftist will support us.
- N.G.O.s will legitimize us.
- C.A.I.R. will incubate us.
- The A.C.L.U. will empower us.
- Western Universities will educate us.
- Mosques will shelter us
- O.P.E.C. will finance us
- Hollywood will love us.
- Kofi Annan and most of the United Nations will cover our asses.

Our children will immigrate from Pakistan, Egypt, Saudi Arabia, Iran, and Indonesia and even from India to the US and to the other Western countries. They will go to the West for education in full scholarship. America is paying and will continue to pay for our children's educations and their upbringing in state funded Islamic schools.

We will use your welfare system. Our children will also send money home while they are preparing for Jihad.

We will take the advantage of American kindness, gullibility, and compassion. When time comes, we will stab them in the back. We will say one thing on the camera and teach another thing to our children at home. We will give subliminal messages to our children to uphold Islam at any cost. Our children in America will always care more about Islamic Country's interest than US interest.

We will teach our children Islamic supremacy from the very childhood. We will teach them not to compromise with Infidel. Once we do that from the very early age our children won't hesitate to be martyr. We will take over the Europe first and then US will be the next. We already have a solid ground in the UK, Holland, Sweden, Spain, Italy, Germany, and now in the US.

Our children will marry Caucasian in Europe and in America. We will mixed with intricate fabric of the Western society but still will remember to Jihad when time comes. Who are we?

We are the "sleeper cells".

We will raise our children to be loyal to Islam and Mohammad only. Everything else is secondary.

At the time of the real fight we will hold our own children as our armor. When American or Israeli troops shoot at us the world will be watching. Imagine,… Imagine the news in the world "Death of Muslim babies by infidels".

We know CNN, ABC, CBS are broadcasting live. Al-Jazeera will pour gasoline on the fire. The news will spread like wildfire. "Americans killed 6 babies, 10 babies". "Jews killed two women",
Keep your Nukes in your curio cabinets. Keep your aircraft carrier or high-tech weaponry in the showcase. You can't use them against us because of your own higher moral standard. We will take the advantage of your higher moral standard and use it against you. We won't hesitate to use our children as suicide bomber against you.

Visualize the news flash all over the world, …Moslem mother is sobbing, ….crying. ….Her babies are killed by Jews and Americans, the whole world is watching live. Hundreds of millions of Muslims all around the world are boiling. They will march through Europe. We will use our women to produce more babies who will in turn be used as armor/shield. Our babies are the gift from Allah for Jihad.

West manufactures their tanks in the factory. We will manufacture our military force by natural means, by producing more babies. That is the way it is cheaper.

You infidels at this site cannot defeat us. We are 1.2 billion. We will double again. Do you have enough bullets to kill us?

On the camera:

- We will always say, "Islam is the religion of Peace."
- We will say, "Jihad is actually inner Jihad."
- Moderate Muslim will say there is no link between Islam and Terrorism and the
West will believe it because the West is so gullible.
- Moderate Muslim all over the world will incubate Jihadist by their talk by defending Islam.
- Using Western Legal system we will assert our Sharia Laws, slowly but surely.
- We will increase in number. We will double again.

You will be impressed when you meet a moderate Muslim personally. As your next-door neighbor, coworker, student, teacher, engineer, professionals you may even like us. You will find us well mannered, polite, humble that will make you say, "wow, Muslims are good and peaceful people", But, we will stab you in your back when you are sleeping as we did on 911.

There will be more 911 in Europe and in America. We will say, "We do not support terrorism but America got what it deserved."

Muslims, CAIR, ISNA, MPAC and other international Islamic Organization will unite. We will partner with Leftist, ACLU, with Koffi Annan, and the UN, and if we have to then even with France. Fasten your seatbelt. The war of civilizations has just begun.

We will recite Quran and say Allah-Hu-Akbar before beheading infidels, as we have been doing it. We will video tape those and send it to all infidels to watch. They will surrender - ISLAM means surrender.

We will use your own values of kindness against you.

You are destined to loose.

Dennis Rodman Forms Topless Basketball Team

NY Post:  Dennis Rodman is bouncing back into basketball — this time as a coach for a topless women's team he's launching for Headquarters Gentlemen's Club, the New York mammary mecca.

The NBA bad boy dreamed up the team after hearing that rival strip joint Rick's Cabaret had launched a league with former Atlanta Hawk Spud Webb, who runs the Texas Legends, an NBA Development League team. Rodman is even challenging Rick's Cabaret's topless team to a charity game.

"I don't know too many men that don't like a good-looking woman running up and down around the court," Rodman told Page Six.  Rodman, who told us he's been a Headquarters customer for more than 30 years, is currently scouting for talent.

He'll be holding auditions next week at the jiggle joint for girls over 5-foot-10 to join the team.  "You don't have to have too much experience, just know how to throw the ball into the hole," was his sterling advice to hopefuls. 

Team members will wear shorts, skimpy shirts and sneakers during games. "They'll come out in a T-shirt or a tank top, but when the game starts, they'll go topless," Rodman boasted.

Many guys may enjoy this form of "entertainment", but really, what woman wants to do this?  Having a basketball thrown at your bare chest just sounds downright painful to me!  Guess some woman will do just about anything for the chance to run around naked...
